We are specifically impacted by INA Section 212 (A) (9) (C) 1
I am an American Citizen from Michigan here is my story. I grew up in Shelby twp, MI where my wife and I met and fell in love. Together we started a family and purchased a home and by all accounts were living the American Dream. Our home, family, friends, church, lives and my businesses are all located in Michigan not Mexico. Our lives have now been turned upside down by the current immigration system. My wife and I have been together for 10 years we have 2 daughters ages 5 & 7 who are also American Citizens. My wife & the mother of our 2 daughters was an illegal immigrant from Mexico, she entered the U.S. illegally in 1998 at the age of 19. We wanted to fix her status in the U.S. to better our family and make things correct with the government. We were voluntarily trying to fix her status here in good faith with the best of intentions. We spoke to several immigration lawyers who advised us she could apply for an I-601 waiver to fix her illegal status. None of the attorneys we spoke to and the attorney’s we hired ever advised us that she was ineligible for the I-601 waiver because she entered the U.S. twice and the amount of time she accumulated in the U.S.
On November, 10, 2011 she voluntarily went back to Mexico for an immigration appointment and consequently our lives would be changed forever. Our I-601 waiver package was never even reviewed because of her dual entry and the amount of time she had acquired in the U.S.
Now she is in Mexico, her punishment from the U.S. government a lifetime ban that we can apply for a waiver after 10 years.
This extreme punishment has devastated our family and caused many severe and undue hardships. My daughters need their mom greatly and have had to move to Mexico to be with her and I am now separated from my family as I am living and working in the United States to support them. My daughters, my wife and I now live with many severe & extreme hardships. The educational, emotional, economical, financial, psychological & social hardships we now live with are all because of this severe punishment the U.S. government has enforced on my wife.
My daughters and I are American citizens and are ultimately the victims of this extreme immigration punishment against her. My wife is a great woman & mother and a person
of good moral character who has never committed a crime in her life except for coming here illegally to try for a better life. This was a mistake she made when she was very young.
There are many U.S. citizens who are suffering from the short falls of the current immigration system like my family and we should not be forgotten or left out of any reform that is enacted. I am asking that I be treated as well as everybody else in comprehensive immigration reform. Please enact reform that addresses waivers & bars of inadmissibility that would re-unite my now broken family.
